Your tips are your money.
Your manager, supervisor, or the owner cannot take your tips.
The law on tips is in Federal Department of Labor Fact Sheet 15 HERE.
You are not required to split your tips or ‘tip out’ non-tipped employees unless you are paid the full minimum wage in your state.
Pooled tips – such as from a tip jar – are split between tipped employees only, unless everyone is paid the full minimum wage.
If you are paid the discounted minimum wage or “server wage” you NEVER have to split your tips unless it is from an established tip pool for those paid server wage.
Managers, owners, and supervisors cannot tip themselves from a tip pool.
Your employer CAN pass on their credit card processing fee to you (about 3%). They cannot charge more than they actually pay.
