Your tips are your money.
Your manager, supervisor, or the owner cannot take your tips.
The law on tips is in Federal Department of Labor Fact Sheet 15 HERE.
You are not required to split your tips or ‘tip out’ non-tipped employees.
Pooled tips – such as from a tip jar – are split between tipped employees only.
Your employer CAN pass on their credit card processing fee to you (about 3%) but they cannot charge more than they pay.
This is FEDERAL LAW. If you are an employer, know the law if you have tipped employees.
The feds do not care if you have been “doing this way for 30 years.” It just took that long to catch you.
